Two men charged over 2021 Swan Creek fatality

Two men will appear in Grafton Local Court next month charged over a fatal crash at Swan Creek last year.

About 6pm on Friday August 6, 2021, emergency services responded to reports a Mazda Bravo ute had been damaged while travelling on Big River Way at Swan Creek, near Grafton.

When officers from the Coffs Clarence Police District attended, they found a 50-metre roll of fencing had landed on the bonnet of the Mazda, impacting heavily with the windscreen.

The driver of the Mazda, a 35-year-old man, was treated at the scene by paramedics before he was airlifted to Gold Coast University Hospital in a critical condition.

His two passengers, an eight-year-old girl and a three-year-old boy, were not injured.

The man died in hospital on August 8.

The crash scene was later examined by officers from the Far North Coast Crash Investigation Unit CIU.

Following enquiries, Far North Coast CIU officers charged two men in relation to the crash.

A 45-year-old man was issued a court attendance notice on Tuesday, October 25, for dangerous driving occasioning death – accessory before the fact and drive unsafely loaded vehicle death/injury occur.

A 67-year-old man was issued a court attendance notice on Thursday November 3 for dangerous driving occasioning death and drive unsafely loaded vehicle death/injury occur.

Both men are due to appear in Grafton Local Court on Monday, December 5.

It will be alleged in court that the 45-year-old and the 67-year-old had shared the driving of the truck carrying the fencing.
