$53.68 million 284 lot Yamba subdivision

A development application for a $53.68 million 284-lot subdivision on Miles Street, Yamba, which was previously withdrawn by the applicant in 2022, has been amended and relodged with Clarence Valley Council.

The initial application lodged by Garrard Building Pty Ltd on behalf of Kahuna No.1 Pty Ltd was submitted to council in August 2019 for 295 lots, but following discussions it was amended in June 2021 to a 310-lot subdivision.

The 310-lot subdivision DA was withdrawn by the applicant in September 2022, before it was set to be determined by the Northern Regional Planning Panel, and when a new DA Sub 2023/0001 for the 284-lot subdivision was resubmitted in December 2022, council requested further information, so the applicant amended the DA.

The Statement of Environmental Effects SEE outlines the amendments to the DA which decreases the number of low density lots to 277, including three lots over 800 square metres sqm for multi-unit housing, and a 8001 sqm medium density precinct, plus a 2000 sqm commercial precinct.

Other amendments to the design include a 1.553-hectare low-density residential development lot in the south west corner of the 42.5 hectare site, an expanded floodway of 10.563 hectares, a road around the southern and eastern boundaries including a 2.5 metre shared pathway linking to existing paths, modification of the stormwater management system to include inter-allotment drainage on lots and biopods within road reserves, and a 5066 sqm park with internal pathway.

The footprint of the subdivision called Yamba Gardens will cover 27.13 hectares of the 42.5-hectare site.

The 277 low-density lots will consist of 81 lots less than 450 sqm (404 sqm smallest) which exceeds council’s 10 per-cent affordable housing target, 98 lots between 450sqm and 480sqm, 55 lots between 480 sqm and 600 sqm, and 43 lots larger than 600sqm, if approved.

“The site, excluding detention basins, the floodway and 2nd order stream with buffer, will require filling to a minimum level of 3.0m AHD to meet the 1 in 100-year Climate Change level,” the SEE states.

To meet council requirements, all houses will be required to have their primary habitable floor level at 3.5m AHD, which may require more fill to be dumped on the site.

Clarence Valley Council is the consent authority for the DA, which also requires approval from the NSW Rural Fire Service and the Department of Planning and Environment.

The DA is currently on public exhibition and submissions are invited, which will be considered by council before the development is referred to the Northern Regional Planning Panel, who will determine if the proposal is approved.

Submissions must be made in writing, they are not considered confidential, they must and quote SUB2023/0001 and be lodged before 4pm on December 18.
